Terms and Conditions

Terms and Conditions are not needed for all businesses.  It is generally advisable for those businesses trading on some form of credit to have Terms and Conditions which, among other things, clarifies exactly when the costs are payable and what happens in the event of default including liability for the cost of taking enforcement action.

Those provisions would generally also provide for interest to be charged.

In service type agreements it is imperative to clarify what will trigger liability for the business’s charges and when those charges are payable.

When providing merchandise consideration does need to be given to whether any form of Title Retention Clause is appropriate and if it is, in addition to the Title Retention Clause, rights to enter upon the buyer’s property to recover merchandise and/or materials which have not been paid for.
