Family LawFamily Law is an area of the law that deals with family-related issues and domestic relations including:

  • the nature of marriage and domestic partnerships;
  • issues arising throughout marriage, including spousal abuse, legitimacy, adoption, child abuse, and child abduction
  • the termination of the relationship and ancillary matters including divorce, annulment, property settlements, and parental responsibility orders


To obtain a divorce you must be married for at least one year and be able to show that your marriage has broken down irretrievably. This can be done by saying:

  1. Your spouse has committed adultery
  2. Your spouse has behaved unreasonably
  3. You and your spouse have lived apart for at least two years and you both consent to a divorce
  4. Your spouse has deserted you for at least two years
  5. You and your spouse have lived apart for at least five years

If there are children involved the Court will look at the arrangements for the children and they may make Orders in relation to them. The Court will not make any orders if you and your spouse are able to agree appropriate future arrangements for your children.

If there is a dispute the Court can decide where the children should live and how much contact each parent should have with them.

Parental responsibility is defined as all the rights, duties, responsibilities which a parent has for a child. In practice this gives you a say in decisions concerning the child’s name, education, travel abroad and medical treatment. If you are married both parents have parental responsibility for children. If the parents are not married only the mother will have Parental Responsibility for the children, unless this has been granted to the father by the mother, or unless the father is registered on the birth certificate after 1st December 2003.  DW Solicitors can advise you as to your rights and responsibilities as a parent so that you can make important decisions concerning your child’s welfare.


Finances are a main consideration for many people considering divorce. Many issues are taken into account when dealing with financial issues on divorce or separation. These include how long you have been married, your respective contributions to the marriage (both financial and otherwise), the value of your assets. The interests of your minor children (under 18 or finished full time education) are the first consideration. Both you and your spouse must provide full and frank disclosure of your financial circumstances, including your assets, income and pensions. We have extensive experience in dealing with financial matters on divorce and can advise you of the best outcome for you.

The cost of a divorce and financial settlement is of significance to most people and we at DW Solicitors pride ourselves on giving the best service for a extremely reasonable price. If a financial settlement can be reached the basic cost of securing the divorce and financial order by agreement should not be significant. We can advise you of the likely costs at your first appointment. If Court proceedings are necessary the costs will be higher. We will keep you fully informed of the costs throughout your case.

Prenuptial Agreements

A Prenuptial agreement is a contract entered into prior to marriage.  The content of a prenuptial agreement can vary widely, but commonly includes provisions for the division of property and support in the event of a divorce or breakup of the marriage.
