Dealing with a loved one’s Estate and affairs following death can be very difficult especially when you are arranging the funeral and trying to keep family and friends informed.

When someone dies without a Will, they are referred to as having died intestate. Depending upon the assets and the value of the assets a Grant of Letters of Administration may need to be obtained from the Probate Registry.  Letters of Administration give authority to those appointed to act on behalf of the deceased.

It may be the case, depending what the assets are and how they are held, that Letters of Administration may not be required. It is, therefore, always prudent to consult us, prior to deciding how to proceed.

When someone dies and they have a Will, the Executors appointed under the Will, would need to apply for a Grant of Probate.  A Grant of Probate, like Letters of Administration, is the authority for the Executors to administer the Estate.  Executors under the Will do, however, have the right to administer certain aspects of the Estate prior to obtaining Probate.

DW Solicitors can assist in advising you and obtaining the necessary Grant required. We can work on a hourly basis or on the basis of an agreed fee.  A large proportion of law firms do, in addition to charging their hourly rate, seek to charge a percentage of the value of the Estate.  DW Solicitors does not seek to charge a premium for the work that it does.
